Indian constitution says every person in India has the right to live and no one can terminate one's life without court's permission. Indian abortion law doesn't permit termination of pregnancies after 20 weeks unless it is fatal to mother.
Nikita Mehta and Haresh Mehta approached court after doctors told them the baby had a hole in heart.
The court has rejected the plea after committee of doctors said the chance that the baby will not be healthy is less and if an abortion is allowed at this stage it will be risky for mother.
Question here is, should they allow to abort ?
For your knowledge, the child to be born will born with a hole in heart. A person with a hole in heart can live normal life, but the problem is, one will get tired very fast compared to normal persons. Now-a-days after a surgery, a pacemaker can be planted in the heart, battery of which lasts for 10 years and after 10 years again one has to under surgery.
I agree the family is living at Bhayander in Mumbai may not be so rich. But for them here I give an example.
Jairaj Shah was staying at Juhu in Mumbai with his wife, Harina, had the same problem in 1972, but they decided to give birth to the child. Doctors estimated expenses of surgery was estimated to 1.50 Lacs at that time (1971). Family of Jairaj and Harina gave them some money, some religious trusts also donated the remaining amount. When the child turned 10, he was operated and pacemaker was kept in the heart. Now the child is 36 years old and is healthy.
In case of Nikita and Haresh, it sounds me they want a child but they are not ready to face any challenge. For them, the above case may force them to think again. Here, they know with what problem, their child will born. What if the same problem may be detected after the birth. Keep aside legal issue, morally, they should not go for abortion. All other matters they should leave to almighty.
One of our relative has a child who is mentally retarded. But hats off to the family, they are looking after him very nicely. Not only the parents but the whole family looks after him.
So, in my opinion, they should not allow for the abortion. This is a curable problem.
A humble request to the Mehtas, Please, do not hate him / her after he / she enters this world.

the latest medical report says that child will be born with no defects. I think this report has been manipulated.
